Section 1. Guarantee to Owner
The Seller (Kayla Bear Newfies llc) guarantees this puppy for congenital hip and heart defects for one year from the dog's date of birth. In the event that a congenital hip or heart defect is found within one year seller will only provide a replacement dog from next available litter, upon the Buyer’s return of the original dog to Kayla Bear Newfies. In order to obtain a replacement dog Buyer (______________________________ ) must supply written report from Buyer's veterinarian to Kayla Bear Newfies stating that the dpg has a congenital hip or heart defect within one year of the dog's date of birth. Seller is not responsible and will not reimburse the Buyer for any medical expenses incurred by Buyer for the dog. The guarantee described in Section 1 does not provide for cash refunds or payments of any kind.

In order to request a replacement dog under this guarantee, the dog must be seen by your vet within 72 hours upon purchase and possession of dog. If it is determined that pup has congenital defect or communicable disease dog must be returned to Kayla Bear Newfies within 14 days of this contract per RSA437 Dept of Agriculture Statute in the state of New Hampshire. Should Buyer decide not to return dog Buyer is responsible for all veterinary expenses for puppy. Returns are subject to replacement fee if buyer does not want replacement dog from next available litter.

Section 2. Ownership and of Dog:
The Buyer assumes the ownership of the puppy upon date of purchase and possession. The Buyer agrees to assume all responsibility for the full and total care, training, medical expenses and liability for any actions of said dog. The Buyer promises to provide and to assume all responsibility for all costs associated with the dog's veterinary care. Buyer agrees to assume all liability associated with the ownership of the dog upon the date of purchase and possession.

Section 3. Care of Dog
The Buyer agrees to help the dog grow to it's full potential in a slow, methodical, and reasonable regimen, and time through proper diet, adequate exercise, and appropriate veterinary care, as needed. Reasonable precautions and care must be taken by the Buyer to protect the puppy from injury by other animals or people. We recommend that the dog not be exposed to other dogs outside of your home until it is at least 16 weeks of age and has been fully vaccinated against
Rabies, Distemper, Parvo, Bortadella, Leptospirosis and Canine Influenza for you and the dog’s protection and well being.

Section 4. Custody and Reselling of Dog
With the exception stated in Section 1 of this contract, all sales are final. Seller will not provide cash refunds Seller retains the option of first right of refusal and/or approval of new home for dog should the Buyer decide to sell said dog. Buyer is solely responsible for the training of said dog and any liability that may arise from any act of said dog from the date of purchase and possession. At no time is said dog to be taken to a humane society without the written consent from Seller. Seller will assist in placing said dog should buyer decide not to keep the dog.

Section 5. Documentation
Dog is sold with health certificate stating the general health of the puppy, vaccine and worming records. AKC/ACA papers are in limited form meaning dog must be spayed/neutered within a year (dog is registered with AKC/ACA and can participate in all AKC /ACA activities except conform-ation events) and pedigree will be mailed within 4-6-weeks from the date of this contract. Only if application any medications included with dog for parasite control include __________________Please give as directed by veterinarian. __________________________________________________________

Section 6. Release and Hold Harmless
The undersigned purchaser(s) do(es) hereby release, discharge and hold Joanne Pomeroy, Louise Pomeroy and any other person, firm or entity associated with Kayla Bear Newfies, their heirs, administrators. executors successors and/or assigns (“Releasees) from any and all claims, medical expenses, damages, costs, expenses, loss of services, actions and causes of actions belonging to said purchaser(s) arising out of any act, omission or occurrence of the Releasees frpm the present date to the end time, for all liability, including but not limited to any liability related to the undersigned ‘s purchase or adoption of any dog from Releasees.
